The short answer

The Act sets a minimum retirement age framework, but coverage and exceptions matter. Its definition of employer excludes the State or Government and other excluded persons or bodies. Read the definitions, the premature-retirement provision and the schedules alongside your employment terms before treating the headline retirement age as the complete rule.

Age and transitional rules

The age provision distinguishes workers by their age when the Act came into operation and workers recruited afterwards. It directs readers to a schedule for older workers at that starting point. A current age alone therefore does not answer the question; compare the commencement position and the applicable schedule.

Early retirement is not one simple rule

The premature-retirement provision contains workforce-size rules, scheduled exclusions and exclusions that may be prescribed for particular work. It also identifies grounds on which an employer may retire a worker early, including certified permanent incapacity, certain disciplinary terminations, natural-cause closure or destruction, and prior written approval under the legislation it cites. The section separately preserves a worker’s choice to leave voluntarily.

How employment terms interact

Subject to the premature-retirement provision, an employment contract or collective agreement setting retirement below the statutory minimum is treated as void to that extent, and the statutory minimum applies. That wording makes the exceptions important. Read the contract together with the Act rather than rely on either in isolation.

The complaint route

The Act provides for a written complaint to the Commissioner-General of Labour by a worker prematurely retired outside the specified grounds. It sets a filing period and an inquiry process. Possible outcomes include dismissal of an unsupported complaint or directions for reinstatement and payment; compensation in lieu of reinstatement is tied to specified circumstances. The section also restricts complaints where another listed labour-law route has been used. Check the time limit and interaction with any existing case promptly.

Prepare the complaint chronology

The cited complaint provision allows a written complaint within two months from the premature retirement. The Commissioner-General must conduct an inquiry and give a final determination within two months from receipt of the complaint. Those are separate periods with different starting events. To prepare the chronology, gather the retirement notice, employment agreement, date employment began, age records and the employer’s stated reason. Also identify any earlier complaint about the same retirement under another labour-law route, because the Act limits when this complaint procedure can be used.

What a successful complaint can produce

If the Commissioner-General finds premature retirement contrary to the Act, the stated direction is reinstatement in the same capacity from the notice date, with wages and other benefits from retirement. Compensation instead of reinstatement is tied to reinstatement being impractical because the establishment has closed or liquidation has begun. The section does not give a worker an unrestricted choice between reinstatement and a cash payment. Keep the remedy sought distinct from the evidence that the retirement fell outside the permitted grounds.
