327. Essential services in liquidation

(1)

Notwithstanding anything to the contrary in any other enactment, a supplier of an essential goods or services shall not –

Rescue, Rehabilitation and Insolvency

(a)

refuse to supply the good or service to a liquidator, or to a company in liquidation, by reason of the company’s default in paying charges due for the good or service in relation to a period before the commencement of the liquidation; or

(b)

make it a condition of the supply of the good or service to a liquidator, or to a company in liquidation, that payment be made of outstanding charges due for the good or service in relation to a period before the commencement of the liquidation.

(2)

The charges incurred by a liquidator for the supply of an essential good or service shall be an expense of the liquidation for the purposes of the Fourth Schedule.
