18. Decision to initiate

(1)

The Director-General shall, having examined the accuracy and adequacy of the evidence provided in the application, determine whether there is sufficient evidence to justify the initiation of an investigation. In arriving at a decision, the Director-General may where necessary, seek further information from the applicant.

(2)

Where the Director-General determines that —

(a)

the application is made by or on behalf of a

Sri Lankan industry; and

(b)

there is sufficient evidence of dumping, injury and causal link within the meaning of this

Act, the Director-General shall decide, within forty days of receipt of the application, whether or not to initiate an investigation.
