s 1Short title

This Act may be cited as the Factories (Amendment)

Act, No. 4 of 2021.

s 2Amendment of section 67 of Chapter 128

Section 67 of the Factories Ordinance (Chapter 128)

(hereinafter referred to as the “principal enactment”) is hereby amended by the repeal of paragraph (b) and the substitution therefor of the following paragraph:-

“(b) in the case of young persons the period of employment shall not exceed twelve hours in any day and shall neither begin earlier than 6 a.m. nor end later than 8 p.m., and on one day in the week, the period of employment shall end by 1 p.m.;”.

s 3Amendment of section 68 of the principal enactment

Section 68(1) of the principal enactment is hereby amended as follows:—

(1)

by the repeal of the words “who have attained sixteen years of age but have not attained eighteen years of age”;

(2)

in the proviso to that subsection by the repeal of the words “who has attained the age of sixteen years but not attained the age of eighteen years,”.

s 4Amendment of section 71 of the principal enactment

Section 71(1) of the principal enactment is hereby amended in the proviso to that section by the repeal of the words “who has attained the age of sixteen”.

s 5Repeal of section 77 of the principal enactment

Section 77 of the principal enactment is hereby repealed.

s 6Amendment of section 86 of the principal enactment

Section 86 of the principal enactment is hereby amended in paragraph (c) thereof by the repeal of the words

“and as if the references to young persons included references to all persons who had not attained the age of eighteen”.

s 7Amendment of section 127 of the principal enactment

Section 127 (1) of the principal enactment is hereby amended by the repeal of the definition of the expression

“young person”, and the substitution therefor, of the following definition:-

“ “young person” means, a person who has attained the age of sixteen years but is under the age of eighteen years.”.

s 8Sinhala text to prevail in case of inconsistency

In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
