36. Licence required for overhead and underground electricity lines

Subject to the provisions of subsection (2), a person shall not install an electricity line above or below the ground, except in accordance with a licence obtained in that behalf in terms of this Act.
The provisions of subsection (1) shall not apply –
to an electricity line or an underground cable which has a nominal voltage not exceeding thirty-three kilovolts, or any other higher voltage as may be determined by the Regulator; and
to such portion of an electricity line as is or will be, within the premises being occupied or is under the control of the person responsible for its installation.
A licence granted under this Act –
may include such conditions (including conditions as to the ownership and operation of the electricity line) as appear to the Regulator to be appropriate;
may be varied or revoked by the Regulator at any time after the end of such period as may be specified in the licence; and
subject to paragraph (b), shall continue in force for such period as may be specified in, or determined by, or under the licence.
The Regulator may direct that an electricity line be designated as a “high voltage line” for the purposes of this
Act.
