29. Amendment of section 44 of the principal enactment

Section 44 of the principal enactment is hereby amended as follows:-

(1)

by the repeal of subsection (1) thereof and the substitution therefor of the following subsection:-

“ (1) Every person guilty of an offence under subsection (1) of section 19 and section 22

shall be liable on conviction by a Magistrate to a fine not less than fifty thousand rupees and not exceeding ten million rupees or to an imprisonment of either description for a term not less than six months and not exceeding three years or to both such fine and imprisonment and in the event of the offence being committed continuously, to a fine of two thousand rupees for each day on which the offence is so committed after conviction.”; and

(2)

by the insertion immediately after subsection (1)

thereof, of the following new subsections:-

“(1A) In addition to the penalty imposed under subsection (1), the Magistrate may make an order to confiscate all telecommunication apparatus used in the commission of the offence under subsection (1) of section 19.

(1B)

Every person guilty of an offence under subsection (5) of section 17B shall be liable on conviction by a Magistrate to a fine not exceeding five million rupees or to an imprisonment of either description for a term not exceeding three years or to both such fine and imprisonment and in the event of the offence being committed continuously, to a fine of ten thousand rupees for each day on which the offence is so committed after conviction.”.
