Twenty Second Amendment to the Constitution

s 1Short title
This Act may be cited as the Twenty Second Amendment to the Constitution.
s 2Amendment of Article 107 of the Constitution of the Democratic Socialist Republic of Sri Lanka
Article 107 of the Constitution of the Democratic
Socialist Republic of Sri Lanka (hereinafter referred to as the “Constitution”) is hereby amended by the repeal of paragraph (5) thereof and the substitution therefor of the following paragraph:-
“(5) The age of retirement of Judges of the
Supreme Court shall be sixty-seven years and of
Judges of the Court of Appeal shall be sixty-five years:
Provided however, the date of retirement of the
Chief Justice shall be either the date on which the
Chief Justice attains the age of sixty-seven years or the date on which a period of six years is completed from the date of appointment as the Chief Justice, whichever occurs earlier:
Provided further, that the term limit of six years set out in the first proviso shall not apply to any person holding the office of Chief Justice as at the date of coming into operation of this Act.”.
s 3Amendment of Article 137 of the Constitution
Article 137 of the Constitution is hereby amended by the substitution for the words “not more than nineteen other Judges” of the words “not more than twenty four other
Judges” .
s 4Sinhala text to prevail in case of inconsistency
In the event of any inconsistency between the Sinhala and Tamil texts of this Act, the Sinhala text shall prevail.
