The provisions of the Mutual Assistan.ce in

Criminal Matters Act, No. 2:5 of 2002 shall, wherever it is necessary for the investigation and prosecution of an offence under section 2 of this Act or an offence described in the

Second Schedule to this Act, be applicable in respect of Ñhe providing of assistance as bet\Veen the Government of Sri

Lank'.a and a State specified in the Fifth Schedule to this

Act with whom the Government of Sri Lanka has entered into an agreement in terms of thÒ aforesaid Act

In the case of a State specified in the Fifth SchÎule with whom the Government of Sri Lanka has not entered into an agrccmcnt, it shall be the duty of the Govcmmcnt to afford aU such assistance to and may through the Minister request all Ï such assistance from, the relevant authorities of the State specified in the Fifth Schedule to this Act as may be necesury for the investigation and prosecution of an offence under section 2 to the extent required for the discharge of itS obligations under the

Convention (including assistance relating to the taking of evidence and statements, the serving of process and the conduct of searches).

The grant of assistance to a convention country may be made subject to sueÐ tenns and conditions as the

Minister thinks fit
