143. Institution of proceedings

(1)

A prosecution for an offence under this Act or any regulation made thereunder shall not be instituted-

(a)

except by an Authorized Officer; and

(b)

after the expiration of a period of three months from the date of detection of that offence or where sample is analysed, after the expiration of a period of one month from the date of the receipt of Analyst’s report on such sample.

(2)

No civil or criminal proceedings shall be instituted against person for any act which in good faith is done or purported to be done by him under this Act or any regulation make thereunder.
