37. Director General to prevent a flight

The Director General or any person duly authorized by the Director General, shall have the power to direct the operator or the crew of an aircraft not to operate the aircraft, in situations where he has sufficient reasons to believe that:—

(a)

the aircraft is not airworthy;

(b)

the crew is not qualified or is physically or mentally in capable of operating the flight;

(c)

the operation would cause imminent danger to persons or property; or

(d)

the aircraft does not have an approved dispatch procedure or is not dispatched in accordance with approved dispatch procedures, and shall in such a situation, take all such steps as are necessary, to detain the aircraft or crew.
