Part XII · Winding Up

350. Saving for rights of creditors and contributories

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

The winding up of a company shall not bar the right of any creditor or contributory to have it wound up by the court, but where an application for winding up is made by a contributory, the court shall be satisfied that the rights of the contributories will be prejudiced by a voluntary winding up.
