Part V

156. Offence by body of persons

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

Where a body of persons is convicted of an offence under this Part, then-

(a)

if such body of persons is a body incorporate or unincorporated, every director or officer or agent thereof; and

(b)

if such body of persons is a firm, every partner, any officer or a member of such firm, shall be liable to a fine as specified for the respective offence:

Provided however, a director or an officer or an agent of such body incorporate, unincorporated or partner of such firm shall not be deemed to be guilty of such offence if he proves that such offence was committed without his knowledge or that he used all due diligence to prevent the commission of such offence.
