46. Order for delivery of possession

(1)

The purchaser of any property sold in pursuance of the preceding provisions of this Part, shall, upon

. application made to the District Court within whose jurisdiction the property is situated and upon production of a certified copy of the certificate of sale issued in respect of that property under section 44, be entitled to obtain an Order for delivery of vacant possession of that property.

(2)

Every application under subsection ( 1) shall be made by way of petition and affidavit to which shall be annexed a certified copy of the Certificate of Sale of the property issued under section 44 and for the purpose of such application and on all proceedings held in consequence of such application made under that subsection by any person other than and person for and on behalf of the Authority stamp duties and other charges shall be payable at the respective rates at which such duties and charges are payable under any written law for the time being in force.
