164. Criminal Liability after Discharge

(1)

Without prejudice to any liability in respect of a subsequent personal insolvency, a debtor has not committed an offence under this Part in respect of anything done after the debtor discharge from a personal insolvency procedure.

(2)

Notwithstanding the provisions of subsection (1), nothing in this Part shall prevent the institution of proceedings against a discharged debtor for an offence committed before such discharge from a personal insolvency procedure.

(3)

Chapter 3 of this part shall apply whether or not the

Bankruptcy Order is annulled, but proceedings in respect of an offence under Chapter 2 shall not be instituted after such annulment.
