Part III

116. Offences by body of persons

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

Where a body of persons is convicted of an offence under this Act, then-

(a)

if such body of persons is a body incorporate or unincorporate or a corporation, every director or officer or agent thereof; and

(b)

if such body of persons is a firm, every partner, shall be liable to a fine as specified for the respective offences:

Provided however, a director or an officer or agent of such body incorporate, unincorporate or of such corporation or partner of such firm shall not be deemed to be guilty of such offence if he proves that such offence was committed without his knowledge or that he used all due diligence to prevent the commission of such offence.
