25. Amendment of section 22 of the principal enactment

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

Section 22 of the principal enactment is hereby amended in subsection (1) of that section as follows: -

(1)

by the substitution for the words “an auditor of an Institution”, of the words “a qualified auditor of an Institution who functions external to the

Institution”;

(2)

by the repeal of paragraph (a) of that subsection, and the substitution therefor, of the following paragraph: -

“(a) relevant to an investigation or prosecution of a person for any unlawful activity;”;

(3)

in paragraph (c) of that subsection, by the substitution for the words

“any offence constituting an unlawful act; or”, of the words

“any offence constituting an unlawful activity;”;

(4)

by the insertion immediately after paragraph (c) of that subsection, of the following new paragraph: -

“(ca) related to the commission of any act constituting the offence of financing of proliferation of weapons of mass destruction; or”; and

(5)

by the substitution for the words “the supervisory authority or the auditor of the Institution”, of the words “such supervisory authority or qualified auditor”.
