8. Term of office of the members of the Commission

(1)

Every member of the Commission shall, unless such member earlier vacates office by death, resignation or removal, hold office for a period of three years and shall not be eligible for reappointment:

Provided however, the members of the First Commission appointed under the provisions of this Act shall hold office from the date of appointment in the following manner:-

(a)

the Chairman shall hold office for a period of five years;

(b)

one other Commissioner other than the Chairman shall hold office for a period of four years; and

(c)

the remaining Commissioner shall hold office for a period of three years.

(2)

Where a vacancy arises in the office of a member of the

Commission due to the expiration of his period of office, such member shall continue in such office until a new member is appointed in his place by the President on the recommedation of the Constitutional Council within three months of the occurring of such vacancy.
