379. Requirement to provide information to receiver

(1)

Where a receiver is appointed in respect of property of a company, every director and other officer of the company shall –

(a)

as soon as practicable and in any event within five working days after the appointment make available to the receiver all books, records and documents relating to the property in receivership in the person’s possession or custody or under the person’s control;

(b)

if required to do so by the receiver, verify by affidavit within a reasonable period that the books, records and documents are complete and correct;

(c)

if the company has a common seal, promptly make the common seal available for use by the receiver; and

(d)

give the receiver such assistance as the receiver may reasonably request.

(2)

On the application of a receiver, the court may make an order requiring a director or other officer of the company to comply with subsection (1).

(3)

A verification under paragraph (b) of subsection (1)

may be qualified in relation to specific matters dealt with in the books, records and documents where the person giving the verification does not –

(a)

consider the books, records and documents to be complete and correct; or

(b)

have the knowledge necessary to give a verification.
