Part I

31. Statement of pre-administration costs

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

A statement of pre-administration costs, if prepared, shall include –

(a)

details of the work done for which, and any agreements under which, the costs, charges and expenses were incurred and the remuneration was charged;

(b)

an explanation of why the work –

(i)

was done before the administration of the company commenced; and

(ii)

was with a view to furthering the achievement of the objective referred to in paragraph (d)

of section 178;

(c)

the unpaid amounts of the pre-administration costs, setting out separately –

Rescue, Rehabilitation and Insolvency

(i)

costs, charges and expenses incurred; and

(ii)

remuneration charged;

(d)

the previously paid amounts (if any) of the pre-administration costs, setting out separately –

(i)

costs, charges and expenses incurred; and

(ii)

remuneration charged; and

(e)

such other information as may be prescribed.
