360. Application for directions by a liquidator or provisional liquidator

(1)

On the application of a liquidator or provisional liquidator or the Authority, the court may –

(a)

give directions in relation to any matter arising in connection with the exercise, perform, discharge of any of the powers, functions and duties of the liquidator or provisional liquidator, as the case may be; or

(b)

revoke or vary any such directions.

Rescue, Rehabilitation and Insolvency

(2)

The powers conferred under subsection (1) –

(a)

shall be addition to any other powers the court may exercise; and

(b)

may be exercised whether or not the liquidator or provisional liquidator, as the case may be, has ceased to act as such when the application is made.

(3)

It is a defence to a claim against a liquidator or provisional liquidator, in relation to any act, omission or decision of the liquidator or provisional liquidator, as the case may be, that the liquidator or provisional liquidator, as the case may be, acted in compliance with a direction given under subsection (1).
