64. Secrecy on transactions

(1)

Every director, manager, officer, employee and agent of any licencee and of any person authorized in terms of subsection (1) of section 42 shall observe strict secrecy in respect of all transactions of such licencee, its customers and the state of accounts of any person and all matters relating thereto and shall not reveal any such matter except-

(a)

when required to do so-

(i)

by a court of law;

(ii)

by the person to whom such matter relates;

(b)

in the performance of the duties of such director, manager, officer, employee and agent; or

(c)

in order to comply with any of the provisions of this Act or any other written law.

(2)

Subject to subsection (1), a licencee shall collect, store, view and use customer data in a manner that effectively protects the privacy of its customers.
