131. Validity of certain payments to bankrupt debtor and assignee

(1)

This section applies where a person makes a payment of money or delivery of property to a person in respect of whom a Bankruptcy Order is subsequently made, or to a person claiming by assignment from such person.

(2)

The payment of money or delivery of property constitutes a good discharge to the person paying the money or delivering the property, where the payment or delivery is made before the actual date on which the Bankruptcy

Order –

(a)

is made, without notice of the presentation of a bankruptcy petition or application; and

(b)

is made pursuant to the ordinary course of business or is otherwise made in good faith.
