Part VIII

165. Personal Insolvency Procedure Applications: False Information

(1)

A person on whose behalf an application or proposal to which this section applies commits an offence, if the person —

(a)

knowingly or recklessly provides information which is false or misleading in a material respect;

or

Rescue, Rehabilitation and Insolvency

(b)

knowingly or recklessly makes a material omission in any statement made under this Act in relation to the person’s financial affairs.

(2)

This section applies to an application or proposal—

(a)

under section 50 for a Debt Protection Moratorium

Order;

(b)

under section 44 for a Debt Restructuring

Arrangement;

(c)

under section 67 for a Debt Rehabilitation Order;

or

(d)

under section 81 for a Bankruptcy Order.
