Part IX

191. Commencement of administration to be recorded

Official English translation. Where it differs from the Sinhala or Tamil text, the Act itself says which text prevails.

(1)

Where an administrator is appointed under section 185, the company shall record in the resolution appointing the administrator the date on which, and the time at which, the resolution was passed.

(2)

Where an administrator is appointed under section 186, the board of the company shall record in the resolution appointing the administrator the date on which, and the time at which, the resolution was passed.

(3)

Where an administrator is appointed under section 188, the liquidator or provisional liquidator, as the case may be, shall record in the instrument appointing the administrator the date on which, and the time at which, the instrument was made.

(4)

Where an administrator is appointed under section 189, the secured creditor or receiver appointing the administrator shall record in the instrument appointing the administrator the date on which, and the time at which, the instrument was made.

(5)

Where an administrator is appointed by court under section 190, the court shall record in the order appointing the liquidator the date and time of the making of such order .
