319. No execution or other process during liquidation

(1)

This section shall not apply to a company for so long as section 302 applies to the company.

(2)

Subject to section 322, during the liquidation of a company, no execution or other legal process, or the levying of distress, against the company or any of its property shall be commenced or continued, except with –

Rescue, Rehabilitation and Insolvency

(a)

the prior, written consent of the liquidator; or

(b)

the permission of the court on such terms and conditions as may be necessary.

(3)

The liquidator shall not be liable in damages for declining to give consent under paragraph (a) of subsection (2).
