402. Application for directions by a receiver

(1)

On the application of the receiver or the Authority, the court may –

(a)

give directions in relation to any matter arising in connection with the performance, exercise or discharge of any of the functions, powers and duties of the receiver;

(b)

revoke or vary any such directions.

(2)

The powers conferred under subsection (1) –

(a)

are in addition to any other powers the court may exercise; and

(b)

may be exercised whether or not the receiver has ceased to act as receiver when the application is made.

(3)

It is a defence to a claim against a receiver, in relation to any act, omission or decision of the receiver, that the receiver acted so in compliance with a direction given under subsection (1).
