Part VI

151. Property of partners to be vested in same Trustee

(1)

Where a Bankruptcy Order has been made under section 90 in relation to a Bankruptcy petition against one member of a partnership —

(a)

any other Bankruptcy petition or application against or by a member of the same partnership shall be filed with the first-mentioned petition;

(b)

unless the court directs otherwise, the same

Bankruptcy Trustee shall be appointed as may have been appointed in respect of the Bankruptcy

Estate of the first-mentioned member of the partnership; and

(c)

the court may give such directions for consolidating the proceedings as it sees fit.

(2)

Where a Bankruptcy Order has been made under section 84 in relation to a bankruptcy application made by one member of a partnership —

(a)

any other Bankruptcy petition or application against or by a member of the same partnership shall be filed with the first-mentioned application;

(b)

unless the court directs otherwise, the same

Bankruptcy Trustee shall be appointed as may

Rescue, Rehabilitation and Insolvency have been appointed in respect of the Bankruptcy

Estate of the first-mentioned member of the partnership; and

(c)

the court may give such directions for consolidating the proceedings as it sees fit.
