Part VI

92. Commencement of Bankruptcy

(1)

The Bankruptcy of a debtor in respect of whom a

Bankruptcy Order has been made —

(a)

commences on the day on which the order is made; and

(b)

continues until the individual is discharged under this Part.

(2)

It shall be presumed that an act was done, or a transaction entered into or effected, after the date of commencement, but the presumption shall not apply if the contrary is proved.

(3)

Unless a Bankruptcy Order is the subject of an appeal –

(a)

no one may later assert that the making of the Bankruptcy Order was not valid or that a prerequisite for commencement was absent; and

(b)

the Bankruptcy Order shall be binding on every person.
