85. Petition for Bankruptcy Order

(1)

A party may apply for a Bankruptcy Order against a debtor in accordance with the following provisions of this

Chapter.

(2)

A petition for a Bankruptcy Order against a debtor under this

Chapter may be presented by —

(a)

a creditor;

(b)

creditors jointly, where there are two or more creditors; or

(c)

the Official Receiver.

(3)

The Official Receiver may petition for a Bankruptcy

Order against a debtor —

(a)

where the court has made an order terminating a Debt Restructuring Arrangement under section 59; or

Rescue, Rehabilitation and Insolvency

(b)

through a request for the conversion of a Debt

Rehabilitation Order into a Bankruptcy Order under section 77.
