261. Application for directions by an administrator or deed administrator

(1)

On the application of an administrator or deed administrator or the Authority, the court may –

(a)

give directions in relation to any matter arising in connection with the performance, exercise and discharge of any of the functions, powers and duties of the administrator or deed administrator, as the case may be;

(b)

revoke or vary any such directions.

(2)

The powers conferred under subsection (1) –

(a)

are in addition to any other powers the court may exercise; and

(b)

may be exercised whether or not the administrator or deed administrator, as the case may be, has ceased to act as such when the application is made.

(3)

It is a defence to a claim against an administrator or deed administrator, in relation to any act, omission or decision of the administrator or deed administrator, as the case may be, that the administrator or deed administrator, as the case may be, acted in compliance with a direction given under subsection (1).
