265. Removal of administrator or deed administrator

(1)

On the application of a person referred to in subsection (3) of section 264 and where the court is satisfied –

(a)

that an administrator or deed administrator has failed to comply with an order made under paragraph (a) of subsection (2) of Section 264;

(b)

that an administrator has ceased to be permitted under section 181 to be appointed or act as administrator; or

(c)

that a deed administrator has ceased to be permitted under section 226 to be appointed or act as deed administrator, the court may make an order removing the administrator or deed administrator, as the case may be, from office and make any other ancillary order as may be necessary.

Rescue, Rehabilitation and Insolvency

(2)

A copy of every order made under subsection (1) shall, within five working days after the making of the order, be sent by the court to the Registrar and Authority.
